COBRA Termination Appeal Process Overview

COBRA members have specific timeframes to make elections, initial payments, and subsequent monthly payments. If your coverage was terminated due to missing one of these timeframes, you may appeal the termination of your coverage.

To start the appeal process, download and complete the COBRA Termination Appeal Form. You may send your completed Termination Appeal Form to service@myameriflex.com.

If your appeal is approved, you can remit COBRA premiums online by accessing your account via our member portal at www.myameriflex.com/participants. Appeal Process Overview:

  1. Receiving the Appeal Determination: After we receive your appeal, we will send a determination letter to the address on file within 30 days via the US Postal Service. Review and update your address to ensure you receive the communication about your appeal status. If you are registered on the COBRA portal, ensure your demographic information is current.
  2. Role of Participant Services:  All appeals are reviewed by an internal COBRA Appeal Board and may take up to 30 days. Our Participant Services team cannot handle or expedite appeals. Once a decision is made, we will notify you by mail.
  3. Outcome Expectations: Submitting an appeal doesn't guarantee reinstatement. Your benefits will remain terminated while your appeal is under review.
  4. Potential Reinstatement: If your benefits are reinstated after your appeal is approved, you will have additional time to pay past-due premiums based on the terms set by your former employer.
  5. Finality of Decisions: All our appeal decisions are final.
  6. Further Appeal Options: If you wish to appeal further, you must contact the Employee Benefits Security Administration, a division within the U.S. Department of Labor, at (866) 444-3272.
